One of the biggest challenges in securing planning permission is not always establishing the principle of development; it is often successfully addressing detailed technical concerns raised by statutory consultees.
At IPD, we recently assisted with a commercial development proposal in Clay Cross, where the Local Highway Authority initially requested further information before it could support the application.
The proposed development involved the removal of existing containers and the construction of new commercial units, together with associated parking, turning areas and servicing facilities. As part of its consultation response, the Highway Authority sought additional evidence relating to a range of transport and highway matters, including:
Visibility and access arrangements
Traffic generation and TRICS assessments
Parking demand analysis
Cycle parking provision
Swept path analysis for HGV movements
Sustainable transport accessibility
Servicing and refuse collection arrangements
To address these concerns, we prepared a comprehensive Transport Statement that provided a detailed assessment of the site’s accessibility, operational requirements and likely transport impacts.
The assessment demonstrated that the proposed development would not result in an unacceptable impact on highway safety. Through robust technical analysis and clear evidence, we were able to respond to each of the Highway Authority’s concerns and support the case for development.
Following its review of the submitted information, the Highway Authority concluded that:
“There are no justifiable grounds on which an objection could be maintained.”
This outcome highlights the importance of thorough technical work, attention to detail and proactive engagement with consultees throughout the planning process. While objections from statutory consultees can present significant challenges, they can often be overcome through well-prepared supporting information and a clear understanding of planning and transport policy requirements.
